It will forever be difficult to imagine life without Lee Moss Kutner, 65, who died peacefully in his sleep and surrounded by his family on December 18. We mourn his passing with a profound sense of loss. He was the beloved and devoted husband of Cynthia Klausner Kutner. They were the love of each other’s lives since the day they met, 38 years ago. Lee was a loving husband, father, and grandfather. Lee was born in Niagara Falls, New York in 1955. When he was nine, his family moved to Oak Park, Michigan. Later, his parents moved to Denver while he was in college. Lee graduated from the University of Michigan in 1976 and then went on to graduate from the National Law Center of George Washington University in Washington, DC in 1980. Lee followed his parents to Denver, and began as an associate in a law practice in 1981, in short time becoming a partner. He later became the primary shareholder in Kutner Brinen, PC where he enjoyed 37 years practicing corporate reorganization and bankruptcy law with his partner and friend Jeff Brinen. Lee pushed the practice of bankruptcy law forward, setting precedent, speaking at conferences, and publishing chapters in respected legal texts. His true joy in life was spending time with his family. He never missed a moment in the lives of his children and never missed a moment to celebrate his wife. He was brilliant, honest, and kind. He told his family he loved them every day, and it was the last thing he told them before he passed. Lee is survived by his wife, Cynthia, his children, Justin (Jennifer Sisk), Alyssa, Mia, and his grandson Charles Julian Kutner. He is also survived by his sister Roslyn Zigmond, and many sisters and brothers-in-law and nieces and nephews. Donations may be made in his honor to the Pancreatic Cancer Action Network or the Hebrew Educational Alliance. Dear Cindy, I worked for Lee and Paul 25 years ago. Lee was such an encouraging and understanding boss and one of the kindest people I have ever met. I don't know anyone who did not like Lee. Even though we lost touch a few years after I left the firm I still tell funny stories about working with him, including when he told me that lawyers should not try to tip the court reporter after a deposition (he was very patient and I was pretty clueless!). Mostly I remember how he spoke about you and your kids with such love and admiration. I hope happy memories of your life with Lee give you comfort in the hard times to come. Your donation will be processed through My Tribute Gift Foundation for distribution to your selected charity. Your credit card transaction record will appear as My Tribute Gift Foundation. An official tax receipt for your donation will be issued by My Tribute Gift Foundation. Donations are sent out to charities at the end of each month for all donations received in that previous month. So a donation made on the first day of the month would be sent at the same time as one made on last day. Payments would be sent either by paper check or direct deposit. Please note that the there is 3% + 35¢/transaction fee for credit card processing, My Tribute Gift Foundation collects a 5% administrative fee. These fees help fund the cost of processing all donations, issuing tax receipts, and sending all appropriate information to the selected charity. These fees are assumed by your selected charity, but you will receive a receipt for the full amount of your donation. There are NO additional costs the charity has to endure to participate and accept donations through MyTributeGift.org. According to the American Institute for Philanthropy (charitywatch.org) a charitable organization is considered “Good” if they are spending less than 30% on administration and fundraising costs. My Tribute Gift Foundation helps reduce those administrative costs for charities and allows donors to contribute to lasting memorials for their loved ones.
When donating online, if the donation form has an option to add a tip, there is no convenience fee. The tip is optional and can be adjusted before you submit your donation. The amount of the tip will be displayed to you before you confirm the charge to your payment card. Tips are in addition to the donation amount, so they do not affect the amount that goes to the charitable organization. Under IRS and CRA rules, tips are not tax deductible to the donor.
You warrant and represent that all information and materials you provide to My Tribute Gift Foundation, through the Website or otherwise, are accurate and truthful and do not violate third party rights. TO THE EXTENT PERMITTED BY LAW, IN NO EVENT SHALL MY TRIBUTE GIFT FOUNDATION OR ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, SERVICE PROVIDERS, AND AGENTS (THE "FOUNDATION PARTIES") BE LIABLE FOR ANY: (i) INDIRECT, CONSEQUENTIAL, INCIDENTAL, SPECIAL, COMPENSATORY OR PUNITIVE DAMAGES; (ii) DAMAGES FOR LOSS OF INCOME, LOSS OF PROFITS, BUSINESS INTERRUPTION, LOSS OF DATA OR DAMAGE TO PROPERTY; (iii) CLAIMS OF THIRD PARTIES; OR (iv) OTHER PECUNIARY LOSS, ARISING OUT OF OR RELATED TO THESE TERMS OF USE, THE WEBSITE OR ANY LINKED SITE. Indemnity. YOU AGREE TO INDEMNIFY AND HOLD HARMLESS THE FOUNDATION PARTIES FROM AND AGAINST ANY AND ALL CLAIMS, DEMANDS, ACTIONS, SUITS AND PROCEEDINGS BROUGHT BY YOU OR ANY THIRD PARTY (COLLECTIVELY "CLAIMS") ARISING OUT OF YOUR USE OF THIS SITE IN BREACH OF THESE TERMS OF USE OR THE INFRINGEMENT BY YOU OF ANY INTELLECTUAL PROPERTY RIGHTS OF ANY PERSON OR ENTITY, INCLUDING ALL LOSSES, LIABILITIES, DAMAGES, COSTS AND EXPENSES (INCLUDING ALL LEGAL FEES) ARISING FROM SUCH CLAIMS.

As a donor, you are responsible for researching the charity, understanding how your money will be used, and understanding the tax implications of your donation. We will email you a receipt, but the deductibility of your donation depends on your individual tax situation. We are not financial, tax, or legal experts. Please do not rely on our information to make decisions about your finances, taxes or legal matters. Consult a qualified professional in your jurisdiction.
Participating organizations have chosen to actively participate in the “Sponsor Program” to be represented in the Sponsor Charity array in an effort to increase their exposure and the opportunity for more memorial donations to be made to their organization. A rate structure is agreed upon and assessed on each donation processed through that program according to each organization’s individual agreement. Giving through that program has helped many organizations realize a drastic and significant increase in net donations.
If a donation form has a line item of Convenience Fee. The Convenience fee is displayed to you prior to approving the charge to your payment card. The convenience fee is in addition to the donation amount, so they do not affect the amount reaching the charitable organization. For example, a $100 donation becomes a $101.50 transaction. The convenience fee is directed immediately to a for-profit service provider. According to IRS and CRA rules the tax deductible receipt will therefore only be issued for the subtotal amount.
My Tribute Gift Foundation seeks to distribute all funds to organizations provided they have maintained active 501c3 certification in the United States or registered charity status in Canada. MTG relies on the beneficiary organizations to maintain and keep up to date contact information on file with the IRS or CRA respectively. This must be done in order for My Tribute Gift Foundation to exercise care and reasonable efforts to distribute payment promptly, without undue cost and burden to the foundation. In the event that a payment has not been deposited 12 months from issuance, the foundation reserves the right to utilize those funds in its mission to the foundation.
My Tribute Gift Foundation reserves the right to modify, change, discontinue and suspend these Terms of Use, the Website, and/or any services offered through the Website, in whole or in part, at any time, without prior notice to you. Your continued access or use of the Website after modifications to these Terms of Use have been posted on the Website shall indicate your acceptance of and agreement to be bound by these Terms of Use as modified.
